Day 45 Identification Rules

Choose One of Three Rules

By Day 45, your written identification must satisfy one of these three IRS rules.

3-Property Rule

Identify up to three properties of any value. The most commonly used rule. Best for most standard exchanges where you have a top pick plus two backups.

200% Rule

Identify any number of properties as long as their combined fair market value does not exceed 200% of the value of the property you sold. Best for diversifying.

95% Rule

Identify any number of properties of any value, BUT you must actually acquire properties worth at least 95% of the total identified value. Risky.
